  2. WHO CAN ENTER
    2.1 Subject to clause 2.2, entry is open to all Townsville residents aged 18 years or older.

2.2. Event/Wedding venues outside of the immediate Townsville surrounds will incur a delivery and set up fee.

3. UNCLAIMED PRIZE DRAW

3.1 Any prizes are valid for 1 year from event date.

4. NO LIABILITY IN RELATION TO HIRE, VOUCHERS AND GIVEAWAYS

4.1 In the case of the intervention of any outside act, agent or event which prevents or significantly hinders the Promoter’s ability to proceed with the competition/hire/scheduled event on the dates and in the manner described in these terms and conditions, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strike, war, act of terrorism, the Promoter may in its absolute discretion cancel the competition and recommence it from the start in the same conditions, subject to State Legislation OR reschedule, schedule permitting, at a later date, agreed upon by both parties.

4.2 Prestige HOPE and their associated agencies and companies will take no responsibility for prizes damaged or late due to unforeseen circumstances. All deposits are non-refundable.

4.3 Prestige HOPE and their associated agencies and companies will not be liable for any misadventure, accident, injury, loss (including but not limited to consequential loss) or claim that may occur:

4.3.1 during the draw;

4.3.2 Whilst undertaking any use of prizes connected with their entry into the draw; or

4.3.3 in the participation in any prize

4.3.4 as a consequence of late, lost or incorrect address given by prize winner;

4.3.5 due to circumstances outside the Promoter’s reasonable control.

4.4 Prestige HOPE and its affiliates assume no responsibility for any error, omission, interruption, deletion, defect, theft or destruction or unauthorised access to, or alteration of, entries, and reserve the right to take any action that may be available.

4.5 If, for any reason, this competition/hire/event is not capable of being conducted as planned, including, but not limited, due to tampering, unauthorised intervention, fraud, technical failures or any other causes beyond the control of the Promoter which corrupt or affect the administration security, fairness, integrity or proper conduct of this competition, the Promoter reserves the right, in its sole discretion, to disqualify any individual who tampers with the entry process, take any action that may be available, and to cancel, terminate, modify or suspend the competition, subject to State legislation.

4.6 All hire items remain the property of Prestige HOPE for the duration of the contracted hire. Items must be returned in the state they were hired. Any damage, breakage or loss of an item must be paid in full by the person who paid the invoice, at the cost of full replacement value.

5. PRIVACY

5.1 The details contained in your entry/emails/facebook interactions are protected by security safeguards. The personal information collected as part of the entry or hire is collected to enable identification of the winner and for future marketing and promotional purposes or for hire information only. Your personal information will only be disclosed to the Promoter and its related bodies corporate for these purposes.

Terms & Conditions — Weddings & Events at Prestige Estate or Prestige HOPE managed event venues.

Our terms and conditions have been set out to ensure all guests enjoy a safe and relaxing time whilst visiting Prestige Estate. Please read this information carefully as it contains important information about weddings or events at Prestige Estate in Majors Creek.

  1. DEFINITIONS

For the purpose of these terms and conditions, the following definitions apply:
‘Event Order’ means the form provided to you prior to your event stating all details of your function.
‘Business Day’ means any day from Monday to Friday inclusive, except public holidays.
‘Resort’ means Prestige Estate, Prestige HOPE managed properties and its managers, supervisors and employees.
‘Resort Premises’ means the premises situated at Prestige Estate, Majors Creek.

  1. BOOKINGS

2.1 Your chosen venue will be held tentatively for seven (7) days, from the date the Resort accepts your booking.
2.2 Confirmation of your booking is required in writing to the Resort, and a deposit payment made (paragraph three (3) below) within seven (7) days of making your booking. If a deposit are not received by the Resort within seven (7) days, the venue will be released and your booking may be cancelled. Exceptions and extensions may apply at management’s discretion. 
2.3 Fourteen (14) clear Business Days before your function, final payment to the Resort is required.

  1. DEPOSITS

4.1 An $500 non-refundable deposit is required within seven (7) days of booking. The deposit is to be paid and payment of deposit is in turn acceptance of the terms and conditions stated herein. Tentative bookings without a deposit paid will only be held for a period of seven (7) days. The Resort reserves the right to release any tentative bookings after the seven (7) days.
4.2 Twelve (12) months prior to your wedding date, 25% of your estimated wedding cost is required to be paid
4.3 Six (6) months prior to your wedding date, 50% of your estimated wedding cost is required to be paid
4.4 Three (3) months prior to your wedding date, 75% of your estimated wedding cost is required to be paid
4.5 Fourteen (14) days prior to your wedding date, 100% of your wedding cost is required to be paid

  1. PAYMENT

5.1 Full payment of your wedding is required at least fourteen (14) days prior to your wedding or event date. Services will not be provided without the final payment being received.
5.2 Any additional charges need to be settled on departure.
5.3 You will be notified for any breakages, damages or incidentals of which you will be solely responsible for.

  1. WEDDING AND EVENT DETAILS

6.1 You are required to provide the Resort in writing particulars of all venues, beverages, entertainment, technical requirements, room setups, starting and finishing times in connection with your wedding or event. These details are required at least one (1) month before your wedding.
6.2 Guaranteed numbers – final attendance numbers must be notified to the Resort twenty-one (21) days prior to your wedding and list of guests camping finalised, this cannot be added to on the day, under any circumstances. Any reduction in attendance numbers within twenty-one (21) days prior to your wedding will be subject to charge at the full contracted amount.
6.3 You must ensure that nothing is nailed, screwed or adhered in any way to any wall, door or another part of the building unless prior permission is granted by the Resort.
6.5 The Resort is a private resort open to other guests. All guests are required to observe house rules, trespass, noise (music is to be turned off after 11.45pm) and general behaviour, particularly at night. Anyone in your party creating nuisance may be asked to leave the Resort Premises immediately and will be liable for any damages caused either to other guests or the proprietor.

  1. WEDDING OR EVENT CANCELLATION

7.1 All cancellations are required in writing.
7.2 All deposits / payments are non-refundable.
7.3 Notice within twelve (12) months of your wedding date, 25% of the wedding cost will be charged.
7.4 Notice within six (6) months of your wedding date, 50% of the wedding cost will be charged.
7.5 Notice within three (3) months of your wedding date, 75% of the wedding cost will be charged.
7.6 Notice within one (1) month of your wedding date, 100% of the wedding cost will be charged.

  1. ACCOMMODATION

8.1 If accommodation for the bride and groom is included in the wedding package, please fill out the attached Wedding Accommodation Form. Once this form is returned, your accommodation will be booked and a confirmation email will be sent to you.
8.2 Guest accommodation is subject to availability and booked on the acceptance of our accommodation terms and conditions (available on the Resort website). All guests are to use designated campgrounds and facilities and observe all rules regarding noise and nuisance. In the instance of QPS attending the property or uncontrollable guest behaviour or noise after midnight, that is not rectified by the nominated booking person, a fee or fine of up to $1000 may be payable.
8.3 Check-in is at 2.00pm and check out is at 10.00am. Please ensure you take this into consideration when selecting your ceremony time as we cannot guarantee an early check-in for your guests. Late checkout for the bride/groom or hirer is at the discretion of the resort.

8.4 On conclusion of the formalities at midnight, prearranged camp guests may retreat to the firepit. There is no time limit or curfew on the firepit, however noise must be kept at talking level only. No music or singing is to occur after midnight, in accordance with QLD law. No additional guests are to stay unless on the approved guest list of people camping. There is to be no more than 40 people camping at any one time and children must be under the care of responsible and sober adult at all times.

  1. CIRCUMSTANCES BEYOND THE CONTROL OF THE RESORT

9.1 If the Resort is unable to provide the facilities or any other arrangements for your wedding or any part thereof, or to otherwise perform the terms of this agreement and the Resort’s failure is due to circumstances beyond its decision or control, the Resort is not responsible for any costs, damages or expenses that you may suffer or incur.
9.2 The Resort cannot guarantee the same co-ordinator throughout the planning process. In the result of a co-ordinator ceasing employment a new co-ordinator will be allocated at the Resort’s discretion.

  1. CONDUCT OF THE WEDDING

10.1 Your wedding or event must be conducted in an orderly and lawful manner. QLD law states that no amplified music is to be played after midnight, this includes boom boxes, car stereos and portable music devices. Please observe all laws in addition to these terms and conditions.
10.2 The Resort may terminate your wedding or event if the Resort reasonably believes that your wedding is not being conducted in an orderly and lawful manner.
10.3 The Resort has no responsibility to you for any costs, damages or expenses that you may incur in relation to the Resort’s termination of your wedding or event.
10.4 The Resort may exclude or remove any persons or possessions from your wedding or from the Resort premises. No food or beverages of any kind, other than those provided by the Resort or prior arranged by the Resort, will be permitted at the wedding and farm stay venue without the consent of a representative of the Resort.
10.6 This Resort practices principles of responsible service of alcohol. Intoxicated persons will not be served alcohol and may be removed from the premises.

  1. SURCHARGES

11.1 A surcharge of $250 per hour is applicable if a wedding continues longer than five (5) hours. This does not apply to family or friends spending time by the fire at conclusion of your wedding or event
11.2 A 15% surcharge is applicable to the total food and beverage account for weddings held on Public Holidays.
11.3 A surcharge of $500 per hour is applicable if a wedding continues longer than five (5) hours on Public Holidays.

  1. EXTERNAL SUPPLIERS
  2. Where goods or services are supplied from an external supplier additional terms and conditions may apply, such as additional deposits, earlier confirmation of final numbers or cancellation fees. You are responsible for any fees that may apply in relation to the supplier’s terms and conditions.
    122 The Resort acts as an agent for external suppliers, such as Photography and Videography, Decorators, Cake Supplier and others, therefore the suppliers hold all responsibility for their services.

13 ITEMS NOT COLLECTED

13.1 Any items that have not been collected after the event will be disposed of within seven (7) days.

  1. THE RESORT WAIVERS RESPONSIBILITY FOR:

14.1 Theft, damage or loss of any goods brought onto the Resort Premises
14.2 Any introduction of food to the wedding or event and the effect of thereafter.

  1. LOSS AND DAMAGE TO THE RESORT PROPERTY

15.1 You are responsible for all loss and damage to the property of the Resort (including the Resort Premises and any fixtures, furnishings or goods on or off the Resort) caused by or arising from any act or omission by you, your guests or any other persons attending your wedding or event or present in the Resort rooms.

  1. SUBSTITUTION OF WEDDING OR EVENT ROOMS

16.1 The Resort may assign you to another area or room for your wedding in the event that the area or room originally designated for your wedding is unavailable for any reason or the Resort believes the area of the Resort originally designated for your function is deemed inappropriate.
16.2 Options for wet weather reception venues may not be held at Prestige Estate, this will be avoided at all costs, however for the safety of our guests and property, Prestige Estate reserves the right to overrule the bride, groom or hirer if the property is unsafe for use, due to unforeseen weather concerns.

  1. PRICE VARIATIONS

17.1 Whilst every effort is made to maintain prices as printed or quoted, they may be subject to increase without notice to cover unforeseen price rises. Please note: each package is increased on January one (1) each year.
17.2 If your wedding date is changed to the next year for any reason, the new wedding package prices and venue hire fees will apply.
